§ 1 scope of application and purpose of the contract

1. Diese Allgemeinen Geschäftsbedingungen (nachfolgend „AGB“) gelten für alle Verträge über die mietweise Überlassung von Parkplätzen zur Unterstellung von Kraftfahrzeugen sowie die Durchführung eines Shuttle-Transfers vom Betriebsgelände Bahnhof 2-10 in 55483 Hirschfeld, zum TRIWO Flughafen Hahn (nachfolgend „Flughafen Hahn“) und zurück. Die Leistungen werden ausschließlich durch Parkpoint (nachfolgend „Anbieter“) erbracht.
2. A contract for a Vehicle, storage, security or Monitoring of the vehicle will not be explicitly closed. § 2 conclusion of the contract

1. The presentation of the services on the Website of the provider, does not represent a legally binding offer but a non-binding solicitation of an offer by the customer.
2. By submitting a booking (via the online reservation form, by E-Mail or by phone), the customer makes a binding offer for the conclusion of a rental and Shuttle contract.
3. The contract is only concluded with the explicit confirmation (booking confirmation) by the provider, in text form (e.g. by E-Mail).

§ 3 prices and payment conditions

1. At the time of conclusion of the contract the agreed prices shall apply. All prices are inclusive of the applicable statutory value-added tax.
2. We offer the following payment options are available for the payment of remuneration available:
   
   • Cash on the spot: The remuneration is paid in cash on arrival at the premises prior to the use of the Parking place.

§ 4 services, Shuttle Service, and flow

1. The provider provides to the customer for the agreed duration a Parking space on the premises available. A claim to a particular Parking space does not exist.

§ 5 rescission and cancellation policy

1. The customer can withdraw up to 24 hours before the agreed commencement of the rental period free of charge from the contract (cancellation). The cancellation must be received by the provider, in text form (e.g. by E-Mail). Payments already made will be fully refunded.
2. In the case of a cancellation of less than 24 hours before day of arrival or in case of no-show of the customer (No Show) without the prior cancellation of the provider reserves the right to charge a cancellation fee in the amount of 50% of the agreed total price as compensation. The customer is entitled to prove that no or a significantly lower damage has been incurred.

§ 6 liability of the provider

1. With respect to the Parking space: The provider is only liable for damages that are due to intentional or grossly negligent breach of duty by the provider, his employees or agents. Since the vehicle is turned off by the customer and sealed, and the keys remain with the client, the provider assumes no liability for theft, vandalism, burglary, damage due to other customers or third parties, as well as for damage caused by force majeure (e.g., hail, storm, Flood, or raccoon damage).
2. With respect to the Shuttle Transfers: For the Shuttle Service (passenger transport) the provider shall be liable in accordance with the statutory provisions. The liability for damage to property in the context of the passenger and baggage transport is limited to three times the price, unless the damage was caused intentionally or due to gross negligence.
3. The provider is not liable for any delays in the Shuttle Transfer, the unpredictable Traffic jams, no-fault accidents, extreme weather conditions or regulatory measures are due. The client is strongly recommended to plan the time of arrival at the Parking lot so that it arrives at least 2.5 to 3 hours prior to departure. For missed flights or resulting follow-up costs, no liability is accepted.

§ 7 obligations and liability of the customer

1. The customer assures that the parked vehicle traffic is secure, and legally required liability insurance protection has, and no liquids (e.g. Oil, fuel, cooling water) loses.
2. The customer is liable for all damages caused by the vehicle (e.g., by leaking operating fluids) or by it self and its accompanying persons at the premises of the provider of the objects of the provider or other vehicles.
3. On the entire premises of the road traffic regulations (StVO) apply. The client on the site applicable to the transport, and to respect warning signs and instructions given by the staff. Vehicles are always moving at a walking pace. The Back of valuables in the vehicle at your own risk.

§ 8 copyright, data protection and final provisions

1. Copyright (Prohibition Of Copying): The contents of these General terms and conditions as well as on the Website of the provider of the published texts and structures are protected by copyright. Any unauthorized reproduction, copy, dissemination, or use – even of extracts – for the commercial purposes of a third party is prohibited without the Express written permission of the Creator and will be prosecuted.
2. In the framework of the booking collected personal data are processed exclusively for the processing of the contract in accordance with the provisions of the data protection basic regulation (DSGVO) and stored. A passing on to third parties, unless this is necessary for the performance of the contract is mandatory.
3. It is the law of the Federal Republic of Germany under exclusion of the UN purchase law.
4. If the customer is a merchant, a legal entity of public Law or a public-law special Fund, the place of jurisdiction for all disputes arising from this contract is the registered office of the provider (within the jurisdiction is the local court of Bad Kreuznach).
5. Individual provisions of this contract should be or become invalid or impracticable, the validity of the remaining provisions shall remain unaffected. Instead of the invalid or unenforceable provision, the legally permissible provision shall be deemed agreed that the economic purpose of the invalid provision.
